DIGITAL PIMPING CHARGES AGAINST BACKPAGE CEO DROPPED

California Superior Court Judge Michael Bowman says he is dropping the digital pimping charges against Backpage.com CEO Carl Ferrer. In a preliminary ruling, he told attorneys for the prosecution and defense that his interpretation of the Communications Decency Act bars the state of California from prosecuting Carl on charges of pimping, pimping a minor, and conspiracy to commit pimping, for which California arrested him in October. “The victimization resulted from the third party’s placement of the ad, not because [of] Backpage profiting from the ad placement,” Judge Bowman wrote. “Congress has spoken on this matter and it is for Congress, not this court, to revisit.” But Carl’s troubles aren’t exactly over; in fact, they are barely beginning. He still faces an investigation and subpoenas issued to Backpage by Congress. And, according to an article in the Chicago Tribune, “Two other cases, in Massachusetts and in Washington State, allege that Backpage is a co-conspirator in an illegal prostitution business. In the Massachusetts case, the plaintiffs were held hostage by traffickers and raped as many as 12 times a day by men who responded to ads on Backpage.com, according to court documents.” Big Daddy Kane said it best, “Pimpin’ ain’t easy.”

CALIFORNIA VOTED FOR HILLARY AND AGAINST CONDOMS IN PORN, BUT YOU CAN’T WIN THEM ALL

California voted for Hillary Clinton, which made her stunning ass whipping at the hands of Donald Trump a little less embarrassing, but by not much. California also took to the ballot to reject Proposition 60, requiring condoms in porn. Voters slapped down the proposition with 53.9% of voters against it and 46.1% in favor. Now, California has required condoms in porn since 1992, but the law is rarely enforced. This new proposal would have added extra teeth, by allowing all California residents to sue porn producers and distributors for profit, if they see a porn scene without condoms. Because porn stars are now heavily invested in their own content and often have a profit interest, they complained that this provision would allow crazy people to get access to their home addresses and telephone numbers. The obvious response, of course, would be for porn stars to just wear condoms. But that doesn’t always prevent the crazies. Because, you know, they’re crazy. Anyway, California voters voted it down. AIDS Healthcare Foundation president Michael Weinstein, who was backed by more than $4.5 million in contributions, said back in August “Many young people get their sex education from performers. They get the message that the only kind of sex is unsafe.” And while proponents claimed this was just all about the kids, we suspect it was more about a war on porn. This battle in the ward goes to porn.

PROSTITUTES PROTEST FOR BACKPAGE

The head of Backpage.com (notorious for its escort services ads since Craigslist left the business) Carl Ferrer, 55, was arrested in early October in Houston, Texas on charges of pimping and conspiracy in California. California and Texas coordinated to take down the owners and CEO, in this election year, with the ultimate hope of bringing down the website. Like any issue in American society, and American politics, there are two sides, equally outraged: those who oppose prostitution, who come in the name of stopping child prostitution (but actually seek to stop all prostitution) and prostitutes, for whom prostitution pays their bills, and in many cases helps them support their children. A dozen protestors showed up in in San Francisco on Tuesday to protest Carl’s arrest. “Do they really want us back on the streets?” said Maxine Doogan, president of the Erotic Service Providers Legal Education and Research Project, who was at the protest. “When we have these websites, people can discreetly arrange their liaisons. If we don’t have the websites, that means we are going back on the streets.” Another protestor echoed that sentiment, saying that Backpage “gives me a safe place to advertise.” She said she had worked in the adult industry for 20 years, under the name Happy Bunny. “Being out on the streets, I can meet strangers who want to attack me,” Happy Bunny added as she screamed, “Stay out of my underwear” during the protest. “I have three kids. I’m just trying to take care of my children,” she said. “We are not here to hurt people.”

But there are reasons to go after Backpage. From 2011 to 2015, there was a 98% increase in child sex trafficking reports, said Staca Shehan, executive director of the National Center for Missing and Exploited Children. She added that 73% of the complaints that her center receives of online child sex trafficking involve Backpage.com. But Rachel West, a spokeswoman from U.S. PROStitutes Collective, asked, “Why doesn’t Kamala Harris [the Attorney General for California] address poverty instead of an easy scapegoat like sex work?” Good question.

In its strongest opposition to condom regulation, and a California ballot measure requiring condoms in porn, Proposition 60, several porn companies have united in protest and blocked California IP addresses from accessing their websites. Some of the biggest names in porn joined yesterday’s black out protest, including Vivid Entertainment Group, Evil Angel, Kink, Pink & White Productions and Treasure Island Media. Vivid had an all-black homepage Monday with a message that said, “If you live in California and Prop 60 passes this is what your porn will look like.” And added, “Harassment is not a California value, No on 60,” providing links to the proposed legislation and arguments against the condom law. Evil Angel also blacked its pages, saying, “We know you don’t want to see condoms in Evil Angel videos, so we’re doing what we can to prevent that from happening … EvilAngel.com is on strike today to raise awareness.” Kink said, “This is what California will see on their favorite porn sites if PROPOSITION 60 passes.” Proponents of Proposition 60 (also known as the Safer Sex in the Adult Film Industry Act), argue the law would limit the spread of HIV and other sexually-transmitted infections in the adult film industry. But it might just black out porn for everyone. And God knows if that happens, all hell will break loose. So take this as a warning California voters. The fate of our porn is in your hands. Help us California, you’re our only hope.

BACKPAGE OFFICES RAIDED AND CEO ARRESTED BY TEXAS LAW ENFORCMENT. DAMN, DON’T MESS WITH TEXAS

Backpage has been the central hub for escorts and prostitution since Craigslist left the market. Backpage rebuffed all appeals and threats to stop. Texas had enough. Texas authorities raided Backpage’s Dallas headquarters today, and arrested its chief executive officer, Carl Ferrer, and charged him with conspiracy and pimping a minor. The two men who founded the company in 2004, Michael Lacey and James Larkin, were also charged with conspiracy. The investigation into Backpage was a joint effort by the states of California and Texas. Ken was arrested based on a California warrant and will be extradited to California to face the charges. “Defendants have known that their website is the United States hub for the illegal sex trade and that many of the people advertised for commercial sex on Backpage are victims of sex trafficking, including children,” said an affidavit for a warrant filed by Brian Fichtner, a special agent of the California Department of Justice. Ken Paxton, the Texas Attorney General, said Carl was arrested after he arrived in Houston on a flight from Amsterdam. “Making money off the backs of innocent human beings by allowing them to be exploited for modern-day slavery is not acceptable in Texas,” Ken, a Republican, said in a statement. “Raking in millions of dollars from the trafficking and exploitation of vulnerable victims is outrageous, despicable and illegal,” said California Attorney General Kamala Harris, a Democrat running for the United States Senate. “Backpage and its executives purposefully and unlawfully designed Backpage to be the world’s top online brothel.” While some will laud this as a huge victory, just as when Craigslist stopped carrying escorts, the traffic will only move from Backpage onto another website, likely now a European or other foreign country website where prostitution is legal or where enforcement standards are less puritanical.

SO, NO CONDOMS IN PORN?

Porn stars and adult performers showed out in big numbers to oppose efforts at tighter restrictions on porn safety standards, in particular against regulations requiring condoms. And in a surprising about face, California’s Occupational Safety & Health Standards Board voted 3-2 against proposed new rules that would have required condoms and other protection in adult film production. The porn industry presented a number of performers and representatives to demonstrate that porn adequately protects performers, and that the regulations would kill porn production in California. “We test at this point every two weeks for a whole panel of tests and there has not been one single HIV transmission on a porn set that follow these protocols since they were implemented,” Ela Darling from the Adult Performer Advocacy Committee said. “When I performed I wore condoms. It was my choice, it was my preference, but I don’t think it’s fair that they need to force that on everybody,” performer Stefanos Tiziano said. “It’s going to push everyone away and the people that can’t move, people like me, I’m going to lose my job,” performer Kevin Quintero said. “It makes it so that we can’t make a competitive product. It makes it so that we don’t actually create the content that is the job that we are doing,” Ela added. After four hours of testimony from both sides, the Board was swayed and rejected the new regulations.

Joseph Smyser, a policy expert for the Centers for Disease Control and Prevention, helped to debunk the arguments of the AIDS Healthcare Foundation, which has aggressively pushed the condom regulations, saying, “I would like to see more evidence that this industry is creating an environment that’s inherently more risky than other environments experienced by the general population,” Joseph said. “I don’t see that from the preponderance of evidence.” But the fight isn’t over. The AIDS Healthcare Foundation said it would file a new petition to OSHA regarding condoms in porn. Michael Weinstein, president of AIDS Healthcare Foundation, said in a statement, “We are disappointed that the Occupational Safety & Health Standards Board failed to complete this years-long process, an action today that would have resulted in improved worker safety for adult film workers in California, but thank them for their work on this over the past six years.” He continued, “To be clear, condom use in adult film production in California—one of only two states in which adult film production is legal—already is required under California’s Bloodborne Pathogens standard. We are announcing today that we will immediately file a new petition with Ca/OSHA on this important health measure.”

CALIFORNIA IS ATTEMPTING TO TACKLE REVENGE PORN WHERE FLORIDA FAILED

California state Senator Anthony Cannella has introduced legislation in California to prevent “revenge porn,” posting of nude images of people (usually exes) without their consent and including identifying information, made all the rage by sites like Hunter Moore’s now defunct — he sold it to an anti-bullying site that shut if down — IsAnyBodyUp.com. The bill is pretty much identical to the legislation introduced in Florida, which failed in the both houses of the Florida legislature last week. But the California bill would only make the crime of “caus[ing] substantial emotional distress or humiliation” by distributing over the Internet nude images with personal identifying information a misdemeanor, not a felony like in Florida.

But the skeptics that helped defeat the revenge porn legislation in Florida don’t believe this bill is any better. Porn industry attorney Larry Walters told XBIZ that the legislation, “While well-intentioned, it criminalizes a form of speech, and may create a situation where erotic content producers will have to pay twice for images or video that is already the subject of a valid model release, just to avoid liability under this new wave of legislation.” He added, “With some reasoned input from the online service provider industry, a viable piece of legislation, imposing civil (as opposed to criminal) remedies could be created.” “But instead, these state legislatures want to take a sledge hammer to solve a problem that requires scalpel precision.”

CALIFORNIA LEGISLATURE MOVES TO REQUIRE CONDOMS IN PORN ACROSS THE STATE

Big brother (the government, not the show) is on the move. Iceland is seeking to ban online porn. Alabama is seeking to ban porn parody. North Carolina is even looking to ban breasts. And California is hoping to expand Measure B (the Los Angeles County law requiring the use of condoms in porn) to the entire state. “Let’s face it, it is completely reasonable for adult film actors to give their co-workers some love without giving them something else,” California Assemblymember Isadore Hall said at a press conference. “When it comes down to it, adult film actors are employees, they need to be respected like any other employee for any other business in the state of California. We have an obligation to ensure that all workers, every last worker, regardless of the type of work you, are protected from workplace hazards and injury.”

Hall believes that the adult industry has failed in its efforts at self-regulation and it is time for the State to step in and protect porn stars (though virtually none support his legislation). “No amount of fluff can lead anyone to believe that exposing these workers to disease or injury is a matter of personal expression,” Hall said. Looks like porn may be moving out of the State of California after all.
